CHAPTER – I
INTRODUCTION
The Employees Provident Fund Organisation (EPFO) being the largest social security
organization in India came into existence in 1952 to administer the institution of provident
fund for employees working in the private/public sector through the Employees’ Provident
Funds & Miscellaneous Provisions Act, 1952. The Employees’ Provident Funds and
Miscellaneous Provisions Act, 1952 a Social Security legislation for the institution of a
statutory Provident Fund Scheme for the benefit of the workers in industrial and commercial
establishments to which the said Act applies, also seeks to ensure sustained financial
assistance in the form of monthly pension in contingencies of superannuation, retirement,
permanent and total disablement and death and to provide a cover of insurance to their
family members.
It now administers three schemes, viz.,
i) Employees’ Provident Funds Scheme, 1952
ii) Employees’ Pension Scheme,1995 and
iii) Employees’ Deposit- Linked Insurance Fund Scheme, 1976
Employees’ Provident Funds Scheme, 1952 provides for contributory provident fund,
Employees’ Pension Scheme, 1995 which, replaced the erstwhile Employees’ Family Pension
Scheme, 1971 from 16.11.1995 provides for monthly pension, and Employees’ Deposit
Linked Insurance Scheme, 1976 provides insurance cover in the event of death of the
worker while in service.
The primary object of these three schemes is to provide a social security umbrella
and to inculcate amongst the workers a spirit of savings while they are gainfully employed
and to make provision for benefit after they retire from service and for their family
members after their death.
The three Schemes, taken together now offer a meaningful social security cover for
the workers in covered industrial and other establishments. Further with the introduction of
special provisions this social security cover is being extended to employees during their
deputation to overseas work places and the benefits have become portable subject to
provisions.

The working of the Organisation in implementing these Schemes during the last 58
years has been one of steady progress, ensuring extension of the membership to more and
more eligible workers.

Chennai is one of the prestigious offices where the implementation of the various
provisions of Employees’ Provident Funds and Miscellaneous Provisions Act, 1952
commenced in November, 1952. Initially the office at Chennai was entrusted the
administration of the Act and Scheme to the establishments within the geographical area
covering the entire state of TamilNadu. Presently Chennai Region’s jurisdiction covers areas
in and around Chennai Metropolitan city with the Regional office situated at Royapettah,
Chennai and a Sub Regional Office at Ambattur. The Zonal Office headed by the Additional
Central Provident Fund Commissioner for the States of TamilNadu & Puducherry and Kerala
is situated at Chennai.

CHAPTER –II
ADMINISTRATION
1. CENTRAL BOARD OF TRUSTEES
The three schemes framed under the Employees’ Provident Funds & Miscellaneous
Provisions Act, 1952 are administered by the Central Board of Trustees which is a
tripartite body appointed by the Central Government and it consists of:

Central Provident Fund Commissioner is Ex-Officio member of the Board.
Main Functions of the Board are :
 Administering the Schemes prescribed under the EPF & MP Act, 1952
 Administering the funds created and vested in the Board
 Maintaining accounts of Income and Expenditure in prescribed form and manner.
 Delegation of powers for administration of the Schemes.
 Submitting audited accounts with comments and Annual Report on performance of
the Organization to the Government of India
 Appointment of Officers
 Declaration of Rate of Interest and other works.
2. EXECUTIVE COMMITTEE
The Executive Committee is a statutory committee, which is constituted from
amongst the members of the Central Board of Trustees by the Central Government under
Section 5AA of the Act to advise Central Board of Trustees in the performance of its
functions relating to administrative matters. It consists of :

Central Provident Fund Commissioner is Ex-Officio Secretary of the Committee.
The Functions of the Executive Committee:

2. Approval for the purchase of land and estimates for construction of office buildings
and staff quarters.
3. Creation of Group ‘A’ posts.
4. Creation of new Regions/Upgradation of existing Regions.

5. Hiring of buildings on monthly rent exceeding ` 50,000/-
6. Consideration of the Investment policy and making appropriate recommendations to
the Board on investment pattern.
7. Specifying work norms for staff and officers of the Organisation.
8. Framing / amending of the rules relating to method of recruitment, pay and
allowances and other conditions of service of the officers and staff of the EPFO.
3. REGIONAL COMMITTEE
Para 4 of the Employees’ Provident Funds Scheme, 1952 provides for constitution
of Regional Committees for each State to advise the Central Board of Trustees on matters
connected with the administration of the Schemes in the State and in particular on :
(i) Progress of recovery of EPF contributions and other charges.
(ii) Expeditious disposal of prosecution cases.
(iii) Speedy settlement of claims.
(iv) Annual Statement of accounts to the members of the Fund and
(v) Speedy sanction of advances.
The Regional Committee of the State of TamilNadu is chaired by the Principal
Secretary, Labour & Employment Department, Government of TamilNadu and the
Secretary of the Committee is the Regional Provident Fund Commissioner-I, Chennai
Region. The Committee comprises of two members each from the State Government,
representing employers and representing employees. The Regional Provident Fund
Commissioner-I of the other regions in the State of TamilNadu and the Additional Central
PF Commissioner, TamilNadu & Kerala would be the special invitees of the Regional
Committee.

CHAPTER –IV
EMPLOYEES’ PROVIDENT FUND SCHEME, 1952
The Employees’ Provident Funds Scheme, 1952 provides for implementation of social
security in the form of compulsory savings through the institution of Provident Fund
whereby both employer and employee are required to contribute at the prescribed
percentage of monthly wages/salary earned by an employee every month.
The employee can also contribute on voluntary basis over and above the prescribed
percentage of employees’ contribution where as employer’s liability for statutory
contribution is presently at ` 6,500/-.
The administration of the Provident Fund, accounting, disposal, maintaining of
members’ accounts, crediting of interest to members’ accounts, issue of statement of
accounts, transfer of accumulations on change of employment by the members, details of
advances/withdrawals alongwith the prescribed eligibility, final settlement to the member,
to the eligible family members in case the death of the member etc., are detailed in the
Employees’ Provident Funds Scheme, 1952.
Special provisions have been made available in respect of Newspaper establishments
and Newspaper employees, Cine workers, persons with disability and International Workers.
The prescribed forms are also provided under the Scheme.

16.11.1995. With its introduction, the erstwhile Family Pension Scheme, 1971 had ceased
to operate. However, the family pensioners who were drawing pension under the erstwhile
Family Pension Scheme, 1971 were allowed to continue to draw the pension under the
Employees’ Pension Scheme, 1995. In certain special circumstances, the Employees’
Pension Scheme, 1995 will also apply with effect from 01.04.1993. Wherever, the members’
had expired between the period from 01.04.1993 to 15.11.1995, the pensionary benefits
would be calculated under both the Schemes and the higher benefit would be paid to the
deceased members family.
All Provident Fund members including those employed in exempted establishments
contributing to the Family Pension Scheme, 1971 and new entrants to Employees’ Provident
Fund Scheme, 1952 shall compulsorily become members of the Employees’ Pension
Scheme, 1995. EPF members who were not members of Family Pension Scheme, 1971
have the option to join the Employees’ Pension Scheme, 1995 on remitting the prescribed
contributions with interest.
B. PENSION FUND
No additional contribution is payable either by the employer or the employee for the
Pension Fund. The Scheme is to be financed by diversion of 8.33% of the PF contribution
from employers’ share of contribution and the Central Government will contribute @ 1.16%
as Government contribution. From 16.11.1995, the employer’s’ share of PF contribution
representing 8.33% of the wage is being diverted to the Pension Fund. All accumulations in
the ceased Family Pension Fund constitutes the corpus of the Employees’ Pension Fund.
C. ELIGIBILITY
A minimum 10 years service including past service under the ceased Family Pension
Scheme, 1971 is required for entitlement of pension. Superannuation pension is payable on
attaining the age of 58 years, while an early pension is also payable on optional basis on
attaining the age of 50 years and on exit where the amount of pension in such cases will be
discounted by 3% for each year by which the age falls short of 58 years. Where service is
less than 10 years, the member has an option to remain covered by obtaining a Scheme
Certificate for pensionary benefits till 58 years of age or get sanctioned the withdrawal
benefits as prescribed. Though the membership under Employees’ Pension Scheme, 1995
continues on obtaining a Scheme Certificate, it ceases on sanction of withdrawal benefit.
On retaining membership, the death risk and consequential pension entitlement to family
members shall remain covered.

D. BENEFITS
The Employees’ Pension Scheme, 1995 provides the following benefit package:
(i) To Member :-
1. Pension for life on superannuation / retirement and total and permanent
disablement;
(ii) To the members of the family upon death of the member;
1. Pension to Widow/Widower for life or till re-marriage;
2. To children / orphan, two at a time upto 25 years age simultaneously with
widow/widower pension;
3. Children / Orphan with total and permanent disability shall be entitled to
payment of children pension / orphan pension as the case may be irrespective of
age and number of children, in the family;
4. Facility for payment of pension to nominee in the event of death of the member
who is unmarried or without any eligible family member to receive pension, and
5. Facility for payment of pension to dependent father / mother in the event the
member dies leaving behind no eligible family members and no eligible
nomination.
E. SALIENT FEATURES OF THE PENSION SCHEME

a minimum of ` 150/- for each child. After the death of the
widow or re-marriage, 75% of widow pension shall be
payable as orphan pension to the children, subject to a
minimum of ` 250/- for each orphan
PENSIONARY BENEFITS ON
DEATH
After death of the member either in service or away from
service, pension to widow (As per Table C) plus 25% of
widow pension to first two surviving children upto their age
of 25 years, pension will continue thereafter to all the
children. After the death of the widow or re-marriage,
75% of widow pension shall be payable as orphan pension
to the children, subject to a minimum of ` 250/- for each
orphan
DISABLEMENT PENSION
Monthly Pension is also paid for entire lifetime on
permanent and total disablement of a member rendering
him/her permanently and totally unfit for the employment
which he/she was doing at the time of such disablement,
based on a medical certificate by the Board.

F. CONTINUED COVERAGE AVAILABLE UNDER THE SCHEME
If a member resigns from services before completion of 10 years of eligible service, he can
avail WITHDRAWAL BENEFIT or can opt for SCHEME CERTIFICATE. He can produce the
scheme certificate to the new employer which will enable him to add the service rendered in
previous employment.
If member resigns from services after completion of 10 years of service but before
completing the age of 50 years, he is entitled only for scheme certificate. He can continue
the service in the new employment. If he does not go for employment he can surrender the
certificate on completion of 50 years and opt for reduced pension and if he expires before
58 years his wife and children shall be entitled for widow and children pension as per
‘Table C’ immediately after his death.
G. VALUATION OF PENSION FUND AS PER PARA 32 OF EMPLOYEES’
PENSION SCHEME, 1995
The Employees’ Pension Scheme, 1995 has a provision to value the Employees’ Pension
Fund every year and based on the position of surplus, annual reliefs may be declared by the
Government of India, which would denote an increase in the Monthly Pension. The results

EMPLOYEES’ DEPOSIT LINKED INSURANCE SCHEME, 1976
A. GENERAL
With a view to providing additional social security to Family of a Member of Provident
Funds who dies in harness and also a positive incentive to the members while in service to
save more, the Employees’ Provident Funds & Miscellaneous Provisions Act, 1952 framed a
Scheme to be called Employees’ Deposit Linked Insurance Scheme, 1976, with effective
from 01.08.1976 to provide Insurance cover to the members of the Provident Fund in
covered establishment linking the cover to the deposits in the Provident Fund of the
deceased member. The benefit needs 12 months average balance preceding the month in
which the death occurred or the period of Membership whichever is less, but non
requirement of minimum average balance in respect of death occurred on or after
01.04.1993, with an assurance of ` 60,000/- with effect from 24.06.2000 instead of
`35,000/- subject to death occurred while in service and submission of claim correctly duly
enclosed with requisite documents.

CHAPTER – VII
EXEMPTED ESTABLISHMENTS
A. GENERAL
Some of the progressive companies in the country had already introduced the
concept of Provident Fund as a social security measure for their employees even before
statutory provisions were enacted by the legislature. When the Employees’ Provident Fund
Act was enacted in 1952, the legislature in its wisdom decided to incorporate a provision to
allow those establishments which give benefits on par with or better than the statutory
scheme to maintain their own Provident Funds. Section 17 of the Act provided for a
mechanism for grant of exemption to those establishments having their own provident
Funds.
On the applicability of the Act to an establishment, the provision of the Employees
Provident Fund Scheme become applicable to it and the employers are required to comply
with statutory provisions of the Scheme. However, such of these establishments, which
have their own Provident Fund Scheme in vogue conferring benefits to their employees
equal to or more than those provided under the statutory scheme may seek exemption
under Section 17 of the Act from the provisions of the statutory scheme, if their employees
are in favour of such exemption. Likewise individual employees or class of employees who
contribute to the employer’s private Provident Fund Scheme may also seek exemption
under Paragraph 27 and 27A of the Statutory Scheme to continue to be members under
their Provident Fund Scheme.
The grant of such exemption is to enable the employees to continue to enjoy the
better benefits available to them under the private Provident Fund Scheme. Such
exemption does not amount to total exclusion from the provisions of the Act and the
exempted establishments continue to be covered under the Act, the only distinction being
that a Board of Trustees properly constituted according to rules in the Exempted
establishment administer the Exempted Provident Fund subject to the terms and conditions
under which exemption is granted and subject to such supervision and control as laid down
by the Government.
Exemption granted to an establishment is liable to be cancelled for contravention of
any of the conditions governing exemption and on such cancellation, the establishment will
be required to comply with statutory scheme. Though the functioning of exempted
establishments is the responsibility of the Board of Trustees in each establishment, the
Organisation exercises its control over such establishments through periodic inspections for
ensuring proper compliance of conditions of exemption.
Similarly the exemption can also be granted from the Employees’ Pension Scheme,
1995 and the Employees’ Deposit Linked Insurance, 1976.
B. CONSEQUENCE OF VIOLATIONS OF THE CONDITIONS/LEGAL
PROVISIONS:
The employer of an Exempted establishment is also subject to the provisions of
Section 6, Section 7A, Section 8 and 14B of the Act. Similarly, under Section 17(1B), Board

of Trustees who violates the provisions of clause (d) of Section 17(1A) shall be deemed to
have committed an offence under Section 4(2A) and punishable with penalties laid down
therein.

EXEMPTION FROM EMPLOYEES’ DEPOSIT LINKED INSURANCE SCHEME,
1976
If the employees in an establishment are entitled for benefits in the nature of Life
Insurance whether linked to the deposits in their Provident Fund or not without payment of
premium or any separate contribution and where benefits of such scheme are more
favourable to such employees than benefits admissible under the EDLI Scheme, 1976, such
establishments are entitled for exemption under Section 17(2A).
At present apart from Life Insurance Corporation of India, some companies listed
below have introduced such group insurance scheme and those establishments who take
group insurance scheme policy of the approved Life Insurance Companies besides Life
Insurance Corporation of India are entitled for exemption under EDLI Scheme.

The exemption is granted by the Central Provident Fund Commissioner on receipt of
a recommendation from Regional P.F. Commissioner. Further, Regional P.F. Commissioners
are also empowered under para 28 of the Employees’ Deposit Linked Insurance Scheme to
grant exemption to establishments who have taken group insurance scheme of Life
Insurance Corporation of India or any of the private insurance companies approved by the
Central Board of Trustees pending formal issued of notification by the Central Provident
Fund Commissioner.
Exemption under EDLI Scheme is given only for a period of three years, after which
the exemption has to be renewed. Proposal for renewal of exemption has to be submitted
by the Regional P.F. Commissioner to the Central P.F. Commissioner. Employers of
establishment exempted from EDLI Scheme have to submit monthly returns to the Regional
P.F. Commissioners every month. They should also submit certain particulars regarding
renewal of Life Insurance Scheme every year, details of cases settled, etc as well as the
proof regarding renewal of the policy to the Regional P.F. Commissioner before the end of
the 3rd year of exemption to enable him to send a proposal for extension of exemption
under EDLI Scheme to Head office.

RECOVERY OF DAMAGES & INTEREST
Section 14B does not confer unguided and uncontrolled direction on the RPFC to
award damages and is not violative of Article 14 of the Constitution. The essentials of
damages are deterrent and reparation and its quantum being determined by pecuniary
compensation and punitive addition and should be determined on the basis of penal element
with the object to recover compensation on default and not to impose penalty.
For an all round review of damages and verification of all establishment files in
various offices, the concept of database I & II was introduced in the year 2001. This
exercise arrived at total review of all the files vis-à-vis damage assessment and
quantification. Each and every establishment file was verified from the date of coverage
and all such establishments which had made belated remittances were identified and action
taken to impose damages under Section 14B of the Act.

Section 14 of the Employees’ Provident Funds & Miscellaneous Provisions Act, 1952

CHAPTER –IX
COMPUTERISATION
The Modernisation project of EPFO involving implementation of work flow oriented
web based application software has been carried out in Regional Office, Chennai during this year. The Regional Office, Chennai is one of the 25 offices selected for the first phase of project implementation. The New hardware such as Servers, Network accessories and Thin Clients has been installed. Proper training in the new application software has been imparted to all the users, in order to implement the modernisation project smoothly. The Modernisation project GO-LIVE was inaugurated by Central Provident Fund Commissioner Sri. K. Chandra Mouli, IAS on 18th January 2010. The Modernisation project envisages computerised working of all staff and officers right from the level of Dealing Assistant up to the level of APFC/RPFC. Various functions such as claim settlement of different types of claim, generation of Pension payment order and payment of pension/arrear through banks, compilation of annual accounts have been computerised. The legacy software such as CAPS,CAMPS, CAMPS95,CRAS, CPAS, CEPS, CCPS have been replaced by the new integrated software which contains various modules such as Establishment module, Member module, Claims module, Pension module, Payment module. All the officials have been given a thin client to work on using their user-id and password in the role assigned to them. The new application software provides best possible services to the provident fund members and
helps in improvement of legacy software in a practical manner.

5. TRAINING
The training sector has been given a new impetus and focus during the last few
years and the emphasis has been to evolve a new administrative set up with emphasis on competence, commitment and performance.
Employees’ P.F. Organisation having recognized the need for training its personnel so as to provide trouble free service to the members, set up an Apex Institution namely, the National Academy for Training & Research in Social Security (NATRSS) at New Delhi in October, 1990.
NATRSS has a two tier structure. The Apex Institute is situated at New Delhi which caters to the needs of Human Resource Development of Group ‘A’ Officers as well as undertaking research and development activities. The courses mounted by the National Academy at New Delhi from Group ‘A’ Officers fall broadly under the following categories :
a. Foundation Programmes
b. Refresher In-Service Programmes
c. Specialised Programmes :
On Social Security Administration, General Administration, Financial
Administration, Computer and Behavioral Sciences etc.
The Second tier consists of Zonal Training Institutes (ZTI) which carry out similar
functions at the four Zonal Level for field formations of the Organisation. For South Zone,
Zonal Training Institute has been set up at Chennai to train the personnel of Andhra
Pradesh, Karnataka, Kerala and Tamilnadu states.

7. PROGRESSIVE USE OF HINDI
The Chennai Region is very conscious regarding the progressive use of Hindi. There are Hindi Sections working both at Regional Office, Chennai and Sub Regional Office, Ambattur. The Regional Office at Chennai has one Assistant Director (Official Language), one Senior Hindi Translator and one Junior Hindi Translator who are looking after the work related to progressive use of Hindi. Likewise at Sub Regional Office, Ambattur, one Junior Hindi Translator looks after the work related to implementation of Hindi.
Translations regarding all documents in respect of Section 3(3) of Official Language Act is done 100%. All reports are furnished well in time. The quarterly meetings of Official Language Implementation Committee(OLIC) are conducted regularly under the Chairmanship of Regional P.F. Commissioner-I and decisions taken therein are monitored from time to time.
Training programme and workshops are organized keeping in view the data available in the Hindi Roster.
Hindi Magazine ‘Nidhi Sanchay” is published regularly from this region.
EPFO (Hindi Usage Incentive) cash award scheme is in force in this office and
employees are awarded under this scheme.
Hindi Books are being purchased regularly for the Hindi Library in Regional Office,
Chennai and Sub Regional Office, Ambattur as per the directions given in he Annual Programme issued by Department of Official Language.
The Assistant Director (Official Language), Regional Office, Chennai inspects the
implementation of Official Language in Sub Regional Office, Ambattur.
Essay Competition for Non Hindi Speaking States was conducted on 22.9.2009 in
Regional Office, Chennai and Sub Regional Office, Ambattur.
The Central Office in its quarterly review has constantly placed the office under
“Excellent” Category.
The Hindi Fortnight and all other programmes are organized as per the norms set by
Central Office / Department of Official Langauge.

8. PHYSICAL FACILITY
The Employees’ Provident Fund Organisation, Chennai Region consisting of
Regional Office at 37, Royapettah High Road, Chennai 600 014 with one Sub
Regional Office at Ambattur.

Regional Office, Chennai :
A new multistorieyed Office Building comprising of Stilt + 4 floors having a total built up area of 52261 Sq. ft. has been constructed and Office of Additional Central P.F.
Commissioner(TN&KR) & Regional P.F. Commissioner-I, all the Accounts groups, Pension Section, EDP have been shifted to the new Building. As a part of modernization project, the building has been furnished with modular workstations in all the floors. The building has also been given air conditioned environment for Ground + 2 floors in the I phase and the proposal for 3rd and 4th floor is in the pipeline.
The maintenance of Civil and Electrical works of the building has been entrusted with AIR (CCW), a Government agency and house keeping has been outsourced.
A Central Record room has been created in the old building to an extent of 8000 Sq. ft. and all the old records have been stored systematically.
A DG set of 62.5 KVA has been installed as Back up power supply. This is in addition to the existing DG set of 75 KVA. Also facility like ramp, toilet and lift has been provided for the physically challenged persons.
Staff Quarters:
The Regional Office, Chennai is having its housing complex at Nungambakkam and Anna Nagar for providing housing facilities to the officers and staff working at Chennai, Ambattur, Tambaram & Zonal Training Institute. There are around 93 flats at Nungambakkam and 104 numbers at Anna Nagar of different types.
The Staff Quarters, Nungambakkam has a Guest House facility for the officers and
staff who visit Chennai for official or personal visits.
The Staff Quarters at Nungambakkam is 35 years old and required a lot of
maintenance work. Hence, the work on maintenance of staff quarters and development works such as construction of storm water drain, road and pavement has been taken up during this year at an estimated cost of Rs. 40 Lacs. Similarly, the staff quarters at Anna Nagar which is also 13 years old structure required lot of maintenance , both internal and external. The work at Staff Quarters was also taken up this year at an estimated cost of Rs.114 Lakhs. The maintenance of staff quarters and office building has been entrusted with All India Radio (CCW), a Government agency functioning under Information and Broadcasting Ministry, Govt. of India.

Sub Regional Office, Ambattur:
The Sub Regional Office, Ambattur functioning under the administrative control of
Regional Office, Chennai is being housed in a building purchased outrightly from the Tamilnadu Housing Board. This office is functioning at 2nd floor and partly in the 1st floor in the same building. Under the modernisation project, the office has been furnished fully with modular furniture. Further, a DG set of 62.5 KVA has been erected recently for backup power supply.

GRIEVANCES
1. REDRESSAL OF GRIEVANCES
The Organisation is always aware of its responsibility and duty towards its members and the beneficiaries. Image of this organization is based on public opinions. The Public Relations Officer(PRO) at the Reception counters maintained by Regional Office, Chennai and all Sub Regional Offices are available in all the working days of the week to handle the grievance of the visiting members.
The system of hearing the grievances of the aggrieved members at the Regional and Sub-Regional Offices was followed with renewed vigor and energy. PROs have been posted in all the offices to assist the aggrieved members in getting their grievances redressed.
In addition to the above, the Regional Provident Fund Commissioner and the Officers in Charge of Sub Regional Offices personally hear the grievances of the members who call on them on all working days and arrange for their grievances getting redressed then and there.
As a measure of ensuring quicker services to members a computer terminal has been provided in the PRO wing of the Regional Office, and all other SROs of the Region. The status of any claim that is received in the office can be viewed from this terminal and print out is also given to the member on the nature of settlement etc. which has the potential of enhancing the satisfaction level of the members visiting this office.

2. BHAVISHYANIDHI ADALATS
As per the standing instructions of the Headquarters, all Regional / Sub Regional
Offices hold Bhavishyanidhi Adalat for resolving grievances and disputes of complex nature.
The Bhavishyanidhi Adalats are held on 10th of every month or the next working day in case 10th happens to be a holiday in all the offices. The performance of the Bhavishyanidhi Adalats has been very encouraging.

CHAPTER –XIII
SPECIAL PROVISIONS IN RESPECT OF INTERNATIONAL WORKERS
The Employees Provident Fund/Employees Pension Schemes are suitably amended to extend the Social Security Benefits to the International workers as a class of employees employed in covered establishments in this Country.
The salient features of the Scheme are as under:
1. It covers also an international worker as defined under Para 2 ff of the Scheme for whom the EFP & MP Act 1952 applies and who are mobile internationally.
2. Subject to the exclusion provision, this class of employees (International Workers) covers certain category of Indian employees(holding Indian passport) and all the employees holding other than an Indian Passport.
3. International workers and their employers have to contribute on the full salary
without any ceiling.
4. Every eligible international worker shall be enrolled with effect from 1st November 2008 (the beginning of the month following that in which the scheme came into force).
5. The payment of benefits in respect of employees holding other than Indian passport hailing from the countries with which India has signed a Social Security Agreement (SSA) shall be governed, wherever applicable, by the provisions of the SSA. (Although, as of now, India has signed SSA with Belgium, France and Germany, the date of effect is yet to be notified. Therefore, as of now, all the eligible employees holding passport other than Indian passport and working in an establishment covered/coverable under the Act, shall be required to be
enrolled while no Indian employee is entitled to become an International
worker).
6. In respect of the employees holding other than Indian passport hailing from the countries with which India has NOT signed a SSA, the payment of withdrawal benefit under para 14 of the EPS, 1995 shall be governed on the principle of reciprocity.
7. An employer is required to furnish details in a statement called IW-1, the particulars of international workers. If there is no international worker is required or entitled to become a member of the Fund, the employee shall send a ‘NIL’ Return.
